President Trump has a major problem at the Supreme Court.
Justices Amy Coney Barrett and John Roberts are going wobbly.
And now Donald Trump is going to hate this Supreme Court ruling.
As American Patriot Daily reports:
President Trump created a viral moment when he called out Maine Democrat Governor Janet Mills to her face over Mills refusing to comply with his executive order banning biological males from competing in girls’ sports.
Polling shows nearly 80 percent of the American people support prohibiting men from playing sports against girls.
Mills dared Trump to sue, saying “I’ll see you in court.”
And Mills will get her wish as the Department of Justice’s Civil Rights Division opened up an investigation into Maine for allowing a biological male to compete in girls’ high school sports.
This case looks earmarked for the Supreme Court.
And despite there being six Republican-appointed justices on the Court and the idea of banning men from women’s sports adhering to the science, one expert thinks Trump is heading for defeat.
That expert is Fox News legal analyst Kerri Urbahn.
“There are some unfavorable decisions out there right now for girls,” Fox News legal analyst Kerri Urbahn cautioned.
Urbahn reminded viewers that in the 2020 Bostock v. Clayton County case, Justices Neil Gorsuch and John Roberts sided with the Court’s liberals to claim that the 1964 Civil Rights Act granted transgenders special rights.
“And secondly, there was a decision by the Supreme Court just about several years ago — authored, interestingly, by Justice [Neil] Gorsuch — where they found that protected sex includes gender identity. So, in other words, if it’s illegal — and it is — to discriminate on the basis of sex, it means it’s also illegal to discriminate on the basis of gender identity,” Urbahn continued.
Urbahn warned this case set up a slippery slope that made it not just illegal to fire transgenders, but also illegal to keep men out of women’s sports.
“This was considered a huge win for people who identify as trans and LGBTQ movement in general at the time. Conservatives were very upset because they saw the writing on the wall and they thought, ‘Well, what is this going to mean for the girls’ sports issue?’ which is probably why Justices [Samuel] Alito, [Clarence] Thomas, and [Brett] Kavanaugh dissented,” Urbahn added.
And that’s why Urbahn lamented the fact that she believes when this case comes before the Supreme Court, Governor Mills and the transgender lobby will emerge victorious.
“Here’s the thing, though: I think if and when the Supreme Court takes this up — and I do think at some point they will even though they’ve declined to do so thus far — I just don’t see them siding with the girls on this issue; but we’re going to have to wait and see,” Urbahn declared.
