One of the Democrats’ attempts at lawfare against Donald Trump suffered a serious setback.
Trump and his supporters were celebrating.
And Donald Trump just won this game-changing victory in court that crushed Democrats’ spirits.
Fulton County District Attorney Fani Willis lost big time in court.
Superior Court Judge Scott McAfee ruled against Willis’s motion to try all 19 defendants – including Donald Trump – starting October 23 after co-defendants Ken Chesebro and Sidney Powell filed a motion requesting a speedy trial.
Chesebro and Powell asked for their cases to be severed from the other 17 co-defendants.
CNN legal analyst Elie Honig explained that this was a huge win for Trump on multiple levels.
First, Honig told CNN viewers that due to the nature of state jury selection procedures and pretrial motions there is no chance Chesebro and Powell’s trial will start on October 23 meaning Trump’s trial will get pushed past the 2024 election.
“So, first of all, this is major news. This means we’re going to have at least two separate trial groups, at least two. First one, Chesebro and Sidney Powell, currently scheduled for late October. I put a question mark on whether we’re actually going to see a trial in October. And then a later group, the other 17 defendants, which very importantly includes Donald Trump,” Honig stated.
“This means two big things to me as a practical matter. One, Donald Trump’s trial in Georgia, the one that will be televised, is way, way, way far out, I think very, very likely to be pushed past the 2024 election, after the 2024 election,” Honig continued.
Willis argued in her motion to try all 19 defendants together on October 23 that the evidence and witnesses the prosecution would present would be the same for everyone charged.
That means Trump and the other 16 co-defendants’ lawyers will have months to preview the questions prosecution plans to ask witnesses and figure out the weak points in the case to exploit on cross-examination.
This is the equivalent of one team turning over their playbook and game plan to their opponents prior to the Super Bowl.
And Honig described this as a major advantage for Donald Trump.
“The second thing is this is a big strategic and tactical advantage for Donald Trump and those other 16, because you know what they get to do now? They get to sit in the gallery and watch the whole earlier trial! They get to see every government witness. They get to see all the cross-examination, all the documents and make notes and adjust accordingly. So big positive development for Donald Trump and the other 16 here,” Honig declared.
Willis’s case being pushed to after the 2024 election means there is now a good chance this case never sees the light of day as if Trump wins re-election there is no chance the federal courts will allow some county DA to try a sitting president.
